1. About OpeninApp
OpeninApp is a service provided by Listed Dotfans Private Limited, an incorporated company with its registered office at 7th, 316 Main, 14th B Cross Rd, Sector 6, HSR Layout, Bengaluru, Karnataka 560102, India (hereinafter referred to as “OpeninApp”, “we”, “our”, or “Company”).
2. Introduction
This document sets forth the Terms of Service (“TnC”) that govern the use of OpeninApp, including both the website www.openinapp.in ("Website") and the OpeninApp mobile application ("App"). These TnC constitute a legal agreement between you (hereinafter referred to as “you,” “your,” or “User”) and OpeninApp. By accessing or using our services through either the Website or the App, you agree to comply with these TnC.
If you do not agree to any part of these TnC, please refrain from using the platform.
3. Modifications to Terms of Service
OpeninApp reserves the right to modify, update, or change any provisions of these TnC at its sole discretion at any time. Changes will be communicated through notifications on the Website or App and may also be sent via email. Continued use of the services after such modifications implies acceptance of the revised terms.
4. Privacy
We respect your privacy. For information about how we collect, use, and protect your personal data, please review our Privacy Policy. By using our platform, you consent to our collection and handling of your personal information as outlined in the Privacy Policy. OpeninApp does not sell user data to third parties, and any disclosure is subject to the terms of our Privacy Policy and legal requirements.
5. Eligibility
To use OpeninApp, you must be at least 18 years of age and legally capable of entering into a binding contract under the Indian Contract Act, 1872. Users who are "incompetent to contract" (including minors or undischarged insolvents) are not permitted to use the platform. Users must provide accurate and current information during the registration process, including a valid mobile phone number or email address, which serves as the primary identifier for their account.
6. Services Overview
6.1 YT Cash
Users submit YouTube video links, and OpeninApp generates relevant affiliate links. Creators earn commissions from the affiliate links based on merchant rates, which vary. OpeninApp takes a 50% commission on total earnings once the creator's earnings exceed ₹500. Affiliate earnings typically become withdrawable between 60-120 days from the transaction date, depending on the affiliate program.
6.2 IG Cash
Users upload images, and OpeninApp generates affiliate links relevant to the image content. Creators earn commissions from these links, and OpeninApp does not charge any commission for this service. Affiliate earnings become withdrawable between 60-120 days.
6.3 Affilinks
Creators can generate and share affiliate links for various products or services, earning commissions based on affiliate merchant programs. OpeninApp does not influence commission rates, and withdrawals follow the standard 60-120 day timeline.
6.4 Call With Fans
Creators can interact with fans via scheduled calls, allowing direct monetization of engagements. No commission is charged by OpeninApp on earnings from this service. Earnings become withdrawable 48 hours after the completion of the call.
6.5 Paid Analytics
Creators can access detailed analytics for their shared links by paying a specified fee. Refunds are handled on a case-by-case basis. Creators must submit refund requests to support@openinapp.com, where the case will be reviewed by OpeninApp.
6.6 Top Secret Link
This product is governed by its own separate Terms of Service, Privacy Policy, and Refund Policy. Please refer to the relevant section on the platform for further details on Top Secret Link.
7. Account Registration & Security
To access OpeninApp services, users must register an account using a valid mobile number or email address. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.
- You must not share your account credentials with others.
- OpeninApp reserves the right to terminate or suspend any account found to be engaging in unlawful or inappropriate activity.
- Users agree to notify OpeninApp immediately of any unauthorized use of their account or any breach of security.
8. Payouts and Withdrawal Policy
Earnings from OpeninApp services are subject to the following withdrawal timelines:
- YT Cash & IG Cash: Withdrawable after 60-120 days, depending on the affiliate program.
- Call With Fans: Withdrawable 48 hours after call completion.
- Top Secret Link: Subject to its own separate terms.
OpeninApp will remit payouts based on the payment details provided by users during registration. OpeninApp is not liable for any delays or errors caused by incorrect payment details or third-party payment processors.
9. User Responsibilities and Prohibited Conduct
9.1 User Content
You are solely responsible for any content you upload, post, or otherwise share on the OpeninApp platform. You represent and warrant that:
- You own all rights to the content you share.
- Your content does not violate any applicable laws, third-party rights, or community standards.
OpeninApp reserves the right to remove or restrict access to any content that violates these TnC or applicable laws.
9.2 Prohibited Conduct
Users agree not to:
- Engage in unlawful activities through the platform.
- Post content that infringes on intellectual property rights or is defamatory, obscene, or otherwise inappropriate.
- Interfere with the platform’s functionality or attempt unauthorized access to OpeninApp’s systems.
OpeninApp reserves the right to terminate any account found to be engaging in such activities.
10. Fees & Payments
OpeninApp offers its services for free; however, certain services, such as Paid Analytics, may require payment. Fees for these services will be clearly displayed, and users agree to pay the specified amount when using fee-based services.
Users are responsible for complying with applicable laws, including tax obligations arising from earnings on OpeninApp.
11. Intellectual Property
All content, logos, trademarks, and other materials on the platform are the intellectual property of OpeninApp or its licensors. Users are prohibited from reproducing, distributing, or otherwise exploiting this content without explicit permission.
Any content uploaded by users remains their property, but by uploading, they grant OpeninApp a worldwide, royalty-free, sublicensable license to use, display, distribute, and modify such content for purposes related to the platform’s services.
12. Termination and Suspension
OpeninApp reserves the right to suspend or terminate any user account at its sole discretion for violations of these TnC or for any other reason at its sole discretion. Upon termination, users may lose access to their accounts and any associated earnings or content.
13. Limitation of Liability
OpeninApp provides its services on an "as-is" and "as-available" basis. OpeninApp does not guarantee uninterrupted access to the platform or any particular outcomes from using its services.
OpeninApp is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use the platform. In no event shall OpeninApp’s total liability exceed the amount paid by the user for services over the past six months.
14. Dispute Resolution and Arbitration
All disputes arising from these TnC will be resolved through binding arbitration in Bengaluru, Karnataka, in accordance with Indian law. The arbitration will be conducted by a single arbitrator appointed by mutual agreement between the parties. If the parties cannot reach an agreement, the arbitrator will be appointed in accordance with the Arbitration and Conciliation Act, 1996.
You agree that any disputes will be conducted on an individual basis, and you waive any right to a class action or representative proceeding.
These TnC shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal action or proceeding that is not subject to arbitration shall be brought exclusively in the courts of Bengaluru, Karnataka.
15. Termination
OpeninApp reserves the right to suspend or terminate your account (or any part thereof) at its sole discretion for any reason, including without limitation for a lack of use or if OpeninApp believes you have violated or acted inconsistently with the letter or spirit of these TnC.
Any suspected fraudulent, abusive, or illegal activity may be grounds for termination of your use of the platform. Upon termination, you may lose access to your account, including any content or earnings associated with it.
If a creator’s association with OpeninApp is terminated for breach of policies or violation of these TnC, OpeninApp will not release any pending payouts to that creator, and the creator agrees to indemnify OpeninApp against any related claims or damages.
16. Disputes Between Users
You are solely responsible for your interactions with any other user of the platform. OpeninApp will not be liable for any disputes or interactions between users.
If a complaint arises against a creator due to user content, OpeninApp may hold back any accrued payments to cover costs associated with contesting such complaints. Charges may include:
- ₹1000 for contesting the complaint in the first stage.
- ₹2000 if the complaint remains unresolved and further contesting is required.
- ₹4000 if proceedings are initiated due to unresolved complaints.
17. General Provisions
These TnC constitute the entire agreement between you and OpeninApp regarding the use of the platform and supersede any prior agreements.
The provisions of these TnC are severable, and if any provision is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
OpeninApp will not be liable for any delay or failure to perform its obligations due to circumstances beyond its reasonable control.
18. Consumer Grievance Redressal
Any grievances or complaints regarding content or breaches of these TnC can be directed to our customer support team at support@openinapp.com. The grievance officer will acknowledge receipt of any complaint within 48 hours and aim to resolve the issue within 15 days.
